Facts:
The wife's bill of complaint alleged acts of physical
violence, indulgence in abusive language, and other unmentionable acts of
cruelty against the husband and prayed for a divorce, alimony, and custody of
the parties' minor children in Prince William. The husband denied the cruelty allegations,
charged the wife with indiscreet conduct and desertion, and prayed for a
divorce and custody. Both parties appealed from the divorce decree, which the
court upheld. The court found it unnecessary to pass on the question of the
husband's right to assign cross-error under the provisions of Va. Sup. Ct. R. 8
since it affirmed the trial court's decree. Further, the court deemed the
evidence of a character that rendered any published discussion of it improper
but concluded that the proof fully warranted the chancellor's conclusion that
the wife was entitled to a divorce on the ground of specific acts of cruelty.
The court also opined that the trial court did not err in its disposition of
the children.

cruelty does not constitute ground for divorce, unless it is so severe and
atrocious as to endanger life, or unless the act indicates an intention to
do serious bodily harm or causes reasonable apprehension of serious danger
in the future, or the precedent or attendant circumstances show that the
acts are likely to be repeated.
