Virginia Court made the following holding:
- When reviewing a chancellor's
decision on appeal, an appellate court views the evidence in the light
most favorable to the prevailing party, granting her the benefit of any
reasonable inferences. That principle requires the court to discard the
evidence of the appellant which conflicts, either directly or
inferentially, with the evidence presented by the appellee at trial.
- Under Va. Code Ann. §
8.01-680, a factual determination cannot be reversed on appeal unless
plainly wrong or without evidence to support it. This standard applies to
a trial court's decision regarding divorce, child custody and visitation,
spousal support, equitable distribution, and attorney's fees. Under this
standard, appellate courts do not retry the facts or substitute our view
of the facts for those of the trial court.
- Constructive desertion
occurs in a marriage where the conduct of the other spouse has caused
conditions in the marital home to be intolerable to the point that the
affected spouse has to leave.
