Holdings:
The
Virginia Court made the following holding:
- Condonation must be
pleaded as an affirmative defense in a defendant's answer to a claim of
adultery. Nevertheless, on its own motion, the court may and should deny a
divorce where it appears from the record that the injured party has
condoned the acts complained of. This is because the interests of the
public as well as those of the individual parties are concerned.
